Always ON Tracking (“Always ON Tracking”, “we”, “us”, or “our”) is committed to protecting your privacy and handling personal information responsibly. This Privacy Policy explains what information we collect, why we collect it, how we use and safeguard it, who we share it with, and the choices and rights available to you. We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws. 1.Information We Collect

We collect only the information necessary to provide, operate, secure, and improve our tracking service. Depending on how you interact with us, this may include the following categories:

  • Account and contact information — your name, business or company name, email address, phone number, and the login credentials you create when you register.
  • Billing and payment information — billing contact details, plan and subscription records, and transaction history. Full payment-card details are collected and processed directly by our third-party payment provider; we do not store complete card numbers on our own systems.
  • Vehicle and asset data — real-time and historical GPS location, routes and trips, and OBD telemetry (such as speed, odometer/mileage, engine hours, RPM, fuel level, engine temperature, VIN, and diagnostic trouble codes) collected from the tracking devices installed in vehicles or assets you own or operate.
  • Usage and technical data — information about how you use our website and platform, including IP address, browser and device type, pages viewed, and system log data, gathered through cookies and similar technologies.
  • Support and communications — the content of the messages, requests, and enquiries you send to us.

2.How We Use Information

We use the information we collect for legitimate business purposes connected to delivering our service. Specifically, we use it to create and administer your account; to operate the tracking platform and display your fleet, trip, and telemetry data; to process payments and manage your subscription; and to send you service-related communications such as alerts, notifications, security notices, invoices, and important updates about the platform.

We also use information to provide customer support, to maintain the security and integrity of the platform (including detecting and preventing fraud, abuse, and unauthorized access), to understand how our service is used so we can improve it, and to comply with our legal and regulatory obligations. We do not use your personal information for purposes that are incompatible with those described here without first obtaining your consent.

3.Location & Vehicle Data

Location and telemetry data are collected continuously from the tracking devices installed in the vehicles and assets you own or operate, and are associated with your account. This data is used to power the features you rely on — live tracking, trip history, geofences, alerts, reports, and vehicle diagnostics — and is visible only to the authorized users within your account (and, where applicable, the reseller that manages your account).

Because location tracking can involve the personal information of drivers and other individuals, you are responsible for having a lawful basis to track your vehicles and for informing your drivers and staff of the tracking, as required by applicable employment and privacy laws in your jurisdiction. You control your data within the platform and may configure retention, access, and sharing among your own users.

4.How We Share Information

We do not sell your personal information, and we do not share it for third-party advertising. We share information only where necessary to operate the service or where required or permitted by law.

  • Service providers — trusted vendors who perform services on our behalf, such as payment processing, cloud hosting and infrastructure, email and SMS delivery, and mapping. These providers are permitted to use your information only to perform services for us and are bound by confidentiality and data-protection obligations.
  • Resellers and partners — if your account is managed through one of our authorized resellers, that reseller has access to the data within the accounts they manage in order to provide you with service and support.
  • Legal and safety — where we reasonably believe disclosure is required to comply with a law, regulation, legal process, or enforceable governmental request, or to protect the rights, property, or safety of Always ON Tracking, our customers, or others.
  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this policy.

5.Data Security

We take the protection of your information seriously and apply administrative, technical, and organizational safeguards appropriate to the sensitivity of the data. These include strict multi-tenant isolation so one customer’s data is never exposed to another, role-based access controls, two-factor authentication, encryption of data in transit and at rest, encrypted off-site backups, and continuous access logging and monitoring.

While we work hard to protect your information, no method of transmission or storage is completely secure. We cannot guarantee absolute security, but we maintain safeguards designed to reduce risk and we will notify affected users and applicable regulators of a material security breach as required by law.

6.Data Retention

We retain your account and vehicle data for as long as your account is active and for as long as needed to provide the service. Historical location and telemetry data are retained so you can access trip history and reports; older detailed records may be compressed or aggregated over time.

We also retain certain records for the periods required to meet our legal, tax, accounting, and regulatory obligations, and to resolve disputes and enforce our agreements. When information is no longer required, we take reasonable steps to securely delete or anonymize it. You may request deletion of your personal information at any time, subject to those legal retention requirements.

7.Your Rights

Under PIPEDA and applicable provincial laws, you have the right to access the personal information we hold about you, to request correction of information that is inaccurate or incomplete, to withdraw consent (subject to legal or contractual restrictions), and to request deletion of your personal information. You may also ask us how your information has been used and to whom it has been disclosed.

If you are not satisfied with our response, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada.
